Illinois Gun/Magazine/Registration Bills

The Senate Public Health Committee passed both HB0815 (Large Capacity Magazine & Shooting Range Licensing Bill) and HB1263 (Semi-Automatic Weapons Ban). Below is an overview of the bills (There are several amendments that I have not reviewed yet):

HB0815

  • Goes into affect 1/1/2014
  • All Shooting Ranges must be Licensed by the Illinois State Police, exempts private clubs
  • Shooting ranges my continue to purchase large capacity magazine, but must register them and can only rent them for use at the range
  • Nobody can fire a weapon at a range without a FOID card
  • Bans all magazines that hold more than 10 rounds
  • Grandfathered all owners of large capacity magazines
    • Must register magazines with State Police within 90 days
    • Can only transfer to an heir or FFL dealer
  • Must report lost or stolen large capacity magazines within 72 hours of knowledge

HB1263

  • Goes into affect 7/1/2013
  • All Shooting Ranges must be Licensed by the Illinois State Police, exempts private clubs
  • Shooting ranges my continue to purchase large capacity magazine, but must register them and can only rent them for use at the range
  • Nobody can fire a weapon at a range without a FOID card
  • Grandfathered all owners of current guns
    • Must register banned guns with State Police within 90 days
    • Can only transfer to an heir or FFL dealer
  • Bans semi-automatic weapons [Defined as]
    • .50 caliber rifles, and .50 caliber cartridges.
    • any of the firearms or types, replicas, or duplicates in any caliber of the firearms, known as:
      • Norinco
      • Mitchell
      • Poly Technologies
      • Avtomat Kalashnikovs (all models)
      • Action Arms Israeli Military Industries; UZI and Galil
      • Beretta AR-70 (SC-70)
      • Colt AR-15
      • Fabrique Nationale FN/FAL, FN/LAR, and FNC
      • SWD M-10, M-11, M-11/9, and M-12
      • Steyr AUG
      • INTRATEC TEC-9, TEC-DC9, and TEC-22
    • any shotgun which contains its ammunition in a revolving cylinder, such as (but not limited the Street Sweeper and Striker 12
    • Semi-automatic rifle or pump-action rifle that can accept a detachable magazine or the following:
      • folding or telescoping stock
      • pistol grip or thumbhole stock
      • shroud that is attached to, or partially or completely encircles the barrel
    • Semi-automatic pistol that has an ability to accept a detachable magazine and has any of the following:
      • folding, telescopingor thumbhole stock
      • shroud that is attached to, or partially or completely encircles the barrel
      • ammunition magazine that attaches to the pistol outside of the pistol grip
      • manufactured weight of 50 ounces or more  when the pistol is unloaded
    • Semi-automatic version of an automatic firearm
    • Semi-automatic rifle or pistol with a fixed magazine that has the capacity to accept more than 10 rounds of ammunition
    • semi-automatic rifle or a pistol with the capacity to accept a detachable magazine, a muzzle brake, or muzzle compensator
    • semi-automatic shotgun with any of the following:
      • folding or telescoping stock
      • a pistol grip or thumbhole stock
      • ability to accept a detachable magazine
      • Fixed magazine capacity in excess of 5 rounds
    • Exempts firearms
      • manually operated by bolt, pump, lever, or slide action
      • inoperable
      • antique
      • rifle with a fixed tubular magazine located under the barrel that is only capable of holding rounds of ammunition placed end to end
      • Air Rifles
      • Olympic Shooting sport rifles

So, the senate passed it, what about the house or was this something that came from the house? If it hasn't passed the house, in your humble opinion, will it pass?

As Charles pointed out, the full Senate did not pass it yet, just the Committee to send it to the full Senate for debate. It was not voted on today due to lack of votes like Charles also stated. Yes, ti will be back, and in my opinion. It will not pass in it's current form.

The current forms of these bills are overly restrictive and focus on aesthetics instead of reality. It currently is a feel good reactionary measure instead of fact based measures that would have a real impact.

Nothing was passed today. They pulled it for lack of votes. Be assured though, the anti-gun crowd will try again. It's important to fight these attempts at passing bad legislation which only penalizes the law abiding firearm owners and not the criminals.

Right. All law abiding gun owers need 50 caliber rifles and magazines that hold over 30 rounds. How else can they shoot that duck? So, so stupid.

The 2nd Amendment isn't about hunting, its about keeping a monarchy, or totalitarian government from forming and affecting the rest of our rights. It is to ensure that the people can rise up and defend themselves if their government grows out of control and begins to oppress them.

These laws that the legislators are trying to ram-rod through will not curtail crime. It will punish the law abiding. Chicago has had a hand gun bill for years and it did nothing to hamper what goes on there. Neither will these new attempts. People have more to fear from people like Sandra Sims who drives down the street talking or texting on her cell phone than they do from me and my firearms which are locked away in a safe.

With regards to your comment Sandra Sims, your statement is nothing more than fear mongering. I live in Lake County and there has not been one incident that I can find where someone was killed or murdered by a .50 caliber rifle or what you folks call "assault weapons" owned by any law abiding FOID holding person.

Yes, I very much like my firearms. As far as "they make you feel like a "man". Well you can thank me and other veterans for defending your 1st Amendment right to come here and insult people like you do. I'll take anything further you have to say as the pat on my back for a job well done.
